SQE1 practice questions
Level: SQE1 candidates
SQE1 tests functioning legal knowledge through single best answer questions in two assessments, FLK1 and FLK2. From January 2027 each assessment has 170 questions in two sessions of 85 (before then it was 180 questions in two sessions of 90). Try these eight free questions written in the SQE1 style, then use Swotly to make unlimited practice from your own notes.
Swotly is not affiliated with the Solicitors Regulation Authority or Kaplan. These are practice questions written in the SQE1 style, not real exam questions.
How SQE1 questions work
Each question gives a short scenario and five options. More than one option can look plausible, but only one is the single best answer. The skill being tested is applying the law to the facts quickly, so practise under time pressure.
- FLK1: business law and practice, dispute resolution, legal services, tort, contract law and legal systems.
- FLK2: wills and the administration of estates, trusts, land law, property law and practice, solicitors accounts, criminal liability, and criminal law and practice.
- Ethics and professional conduct can come up anywhere.

Q1/8A testator signs her will in front of one witness. A second witness arrives ten minutes later. The testator then acknowledges her signature to both witnesses together, and each witness signs in her presence while the other has stepped out of the room. Is the will validly executed?
Section 9 of the Wills Act 1837 lets the testator sign or acknowledge her signature in the presence of two witnesses present at the same time. Each witness must sign or acknowledge in the testator's presence, but not necessarily in each other's.
Q2/8A suspect is arrested for an indictable offence and held at the police station without charge. Up to what point can an officer of the rank of superintendent or above authorise his continued detention, before a warrant of further detention from magistrates is needed?
The basic limit is 24 hours (Police and Criminal Evidence Act 1984, s 41). A superintendent can extend this to 36 hours for an indictable offence (s 42). Beyond that, magistrates can issue warrants of further detention up to a maximum of 96 hours (ss 43 and 44).
Q3/8On 1 March a seller writes offering to sell goods. On 3 March the buyer posts a properly stamped and addressed acceptance, which is delayed and arrives on 8 March. On 5 March the seller posts a letter revoking the offer, which arrives on 6 March. Which statement best describes the position?
Under the postal rule (Adams v Lindsell (1818)) acceptance takes effect when posted. Revocation takes effect only when received (Byrne v Van Tienhoven (1880)), which was after 3 March.
Q4/8A claimant is injured in a road accident caused by the defendant's negligence. What is the primary limitation period for the personal injury claim?
Limitation Act 1980, ss 11 and 14. The general six-year period for tort does not apply to personal injury claims.
Q5/8A will says: 'I leave my shares to my brother, in the hope that he will use them for the benefit of our family.' What is the most likely result?
Precatory words such as 'in the hope that' usually do not create a trust (Re Adams and the Kensington Vestry (1884)). Without certainty of intention, the brother takes the gift outright.
Q6/8Which of the following is NOT one of the characteristics of an easement set out in Re Ellenborough Park (1956)?
Re Ellenborough Park requires a dominant and a servient tenement, a right that accommodates the dominant tenement, different owners or occupiers, and a right capable of forming the subject matter of a grant. There is no requirement of annual use.
Q7/8A solicitor receives £500 from a client on account of costs, before any bill has been sent. Under the SRA Accounts Rules, how should the money be dealt with?
Money received for fees before a bill for them has been delivered is client money, and client money must be paid promptly into a client account.
Q8/8In Council of Civil Service Unions v Minister for the Civil Service (1985), the GCHQ case, the House of Lords held that:
The House of Lords confirmed that prerogative powers are not immune from review, but national security outweighed the unions' expectation of consultation.
